Terms of Service

These terms are a binding agreement between you and @batfolx ("we", "us"), who personally runs the Slopbot Discord bot and this website (together, "the Service"). Slopbot is a private, independent project operated by one individual on his own hardware, not by a company or any third-party operator, and it is not affiliated with or endorsed by Discord. By adding Slopbot to a server or using it in any way, you agree to these terms and to our Privacy Policy. If you add the bot to a server, you accept them for that server too. If you don't agree, don't use the Service. Section 11 contains an arbitration agreement and a class action waiver.

1. Eligibility

You must be at least 13 (or the minimum age Discord requires where you live) and allowed to use Discord. Discord's Terms of Service and Community Guidelines also apply whenever you use Slopbot.

2. Prohibited content and conduct

You may not use the Service to create, request, upload or share:

• Sexual content involving anyone under 18, including fictional, animated or age-ambiguous characters.
• Sexual or intimate imagery of a real person, including "deepfakes", whether or not they consent.
• Content that harasses, threatens, defames or incites violence or hatred against any person or group.
• Content that impersonates a real person or is meant to deceive people about real events.
• Anything illegal, or that infringes anyone's copyright, trademark, privacy or publicity rights.
• Files you don't have the right to upload.

Graphic, violent, gory or adult content is subject to Discord's Community Guidelines and Terms of Service. Anything Discord prohibits is prohibited here, and anything Discord restricts (for example to age-restricted channels) must only be requested and posted where Discord allows it. Server owners are responsible for where the bot can post.

You also may not overload, attack, scrape, reverse-engineer or get around the Service's limits, credits or content checks; use more than one server or account to get extra free credits; or resell or redistribute access to the Service.

3. Your content and the results

You are solely responsible for the prompts and files you send and for what you do with the results. You confirm you have every right needed to send them. You grant us a worldwide, royalty-free license to store, process, reproduce and post your inputs and the results made from them, as needed to run and improve the reliability of the Service. This license ends when the content is deleted from our systems.

Results are generated automatically by AI. They can be wrong, offensive, unexpected, or similar to results made for others, and we don't review them before they are posted. We claim no ownership of your results, but we make no promise that you can own, copyright or safely use them.

We do not keep your content long-term and are not a storage service. Save anything you want to keep.

4. Enforcement

We may refuse any request, delete any content, and suspend or permanently block any user or server, at any time, for any reason or no reason, with or without notice and without refund of unused credits. We may use automated content checks and may report illegal content to the authorities. Copyright complaints can be sent to dragoongod@gmail.com.

5. Plans, credits and payments

• Plans apply to a whole Discord server; everyone in it shares the server's monthly credits.
• Subscriptions are sold, billed and refunded by Discord under Discord's terms. The price Discord shows at checkout is the price you pay. We do not issue refunds ourselves.
• Credits are a limited license to use the Service, not money or property. They have no cash value, can't be transferred or sold, reset each billing period and don't roll over.
• The bot shows a request's cost before it starts and only spends credits once the result is delivered. Requests queued at the same time can take a balance below zero.
• We may change plans, prices, credit costs, allowances and the free tier at any time. Price changes to an active subscription apply from the next billing period.

6. Availability

The Service runs on our own hardware. It may be slow, interrupted, or unavailable, and we may change, limit or shut down any part of it, or all of it, at any time. Render times, quality and features are not guaranteed.

7. No warranties

THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.

8. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, PROFITS OR GOODWILL, ARISING FROM THE SERVICE OR ANY RESULT. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT PAID FOR THE AFFECTED SERVER'S SUBSCRIPTION IN THE THREE MONTHS BEFORE THE CLAIM, OR US$10.

9. Indemnity

You will defend and hold us harmless from any claims, damages, losses and costs (including reasonable attorneys' fees) arising from your content, your use of the Service or the results, or your breach of these terms or of anyone's rights.

10. Ending

You can stop at any time by removing the bot and cancelling any subscription in Discord. We can end your access at any time under Section 4. Sections 3 and 7 to 12 survive.

11. Disputes: arbitration and class action waiver

Before filing any claim, contact us at dragoongod@gmail.com and give us 30 days to resolve it informally. If we can't, any dispute arising from these terms or the Service will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, not in court, except that either side may bring an individual claim in small claims court. You and we waive any right to a jury trial and to bring or join any class, collective or representative action. You may opt out of this section by emailing us within 30 days of first using the Service. If this section is found unenforceable, disputes go to the courts described in Section 12.

12. General

These terms are governed by the laws of the Commonwealth of Virginia and applicable federal law of the United States, without regard to conflict-of-law rules. Any dispute not resolved by arbitration will be heard only in the state or federal courts located in Virginia, and you consent to their jurisdiction. None of this removes any rights you have under mandatory consumer laws where you live. If any part is unenforceable, the rest still applies. Our not enforcing a right is not a waiver. These terms and the Privacy Policy are the entire agreement between us. We may update these terms at any time by changing the date above; using the Service after a change means you accept it.
